Welcome to Onwords, which is owned and operated by Pamango LLC ("Pamango", "we", or "us"). These Terms of Service are a contract between you and Pamango.
Onwords is a digital publishing platform for writers and readers. When you create an account or use Onwords, you agree to these Terms. If you do not agree to these terms, you cannot use Onwords services.
The following are restrictions on who can use Onwords:
To access Onwords and its services, you may have to register for an account. When you register for an account, you may need to provide us with some information about yourself, such as your email address or username.
You're responsible for all activity on your account and you are responsible for maintaining the confidentiality of your account. If you believe your account is no longer secure, notify us immediately at firstname.lastname@example.org.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar, or obscene.
To provide a safe and enjoyable experience for everyone on Onwords, you cannot use Onwords in the following ways:
Before posting any content on Onwords, please read our Content Guidelines. If your content does not comply with these guidelines, it may be removed at any time.
You own all the rights to the content you create and post on Onwords. Do not post any content you do not hold the copyright for (unless you have permission to do so, including the ability to grant Onwords all the rights outlined in these terms). If you post content that is not yours to begin with, posting it on Onwords does not make it yours.
By posting content on Onwords, you represent and warrant that:
We reserve the right to terminate the account of anyone found to be infringing on a copyright. To learn more about how we deal with copyright issues, please read our DMCA policy.
You are responsible for the content you post. Which means you assume all risks related to publication and display, including someone's reliance on its accuracy and any claims related to intellectual property or other legal rights.
When you post content on Onwords, you grant us the right and a nonexclusive license to publish your content, including anything related to publishing it (like storing, reformatting, displaying, and distributing it).
Finally, you may not distribute, modify, transmit, reuse, download, repost, copy, or use any content on Onwords (that is not your own), whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.
We maintain the right but not the obligation to monitor and edit all content provided by users.
We may terminate or suspend your account and access to Onwords immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.
We may withdraw or amend Onwords services or products at our discretion without notice. We are not liable if for any reason all or any part of Onwords is unavailable at any time or for any period. From time to time, we may restrict access to some or all of Onwords to users, including registered users.
If you provide feedback or suggestions, we can use them without compensating you, and without any restriction or obligation to you.
Certain features of the service may require you to pay fees. Before you pay any fees, you will have the opportunity to review and accept the fees that you will be charged.
Subscriptions: Some Onwords services may be billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Pamango cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting us at email@example.com.
A valid payment method, including credit card, is required to process the payment for your subscription. You shall provide Pamango with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Pamango to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, Pamango will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
Onwords services and its original content (excluding content provided by our users), features, branding, and functionality are and will remain the exclusive property of Pamango.
You may not copy, scrape, modify, distribute, sell, lease, or create derivative works of any part of Onwords, nor may you reverse engineer or attempt to extract the source code of the software.
We respect the intellectual property rights of others. It's our policy to respond to any claim that content posted on Onwords infringes on the copyright or other intellectual property rights of any person or entity.
If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in any way that constitutes copyright infringement, please email us at firstname.lastname@example.org, with the subject line: "Copyright Infringement" and include in your claim a detailed description of the alleged infringement.
You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any content found on Onwords on your copyright.

ONWORDS IS PROVIDED BY PAMANGO LLC ON AN “AS IS” AND “AS AVAILABLE” BASIS. PAMANGO LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK.
NEITHER PAMANGO LLC NOR ANY PERSON ASSOCIATED WITH COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. WITHOUT LIMITING THE FOREGOING, NEITHER COMPANY NOR ANYONE ASSOCIATED WITH COMPANY REPRESENTS OR WARRANTS THAT THE SERVICES, THEIR CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SERVICES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.
PAMANGO LLC HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF COMPANY, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
